Buyers Agent Terms & Conditions
- Introduction
These Terms and Conditions outline the agreement between the Client (“Client”, “You”) and the Buyers Agency (“We”, “Us”, “Our”). By engaging our services, you agree to the terms set out in this document.
Our role as a Buyers Agent is to assist clients in researching, identifying, negotiating, and securing suitable property opportunities that align with their goals.
- Services Provided
Our services may include, but are not limited to:
- Property search and identification
- Market research and suburb analysis
- Property inspections and evaluation
- Due diligence coordination
- Shortlisting and presenting suitable properties
- Negotiation with vendors or selling agents
- Auction bidding services (if agreed)
- Guidance throughout the purchase process
The exact services provided will be outlined in the Client Engagement Agreement.
- Client Responsibilities
The Client agrees to:
- Provide accurate personal and financial information
- Obtain finance pre-approval where required
- Engage a solicitor or conveyancer for legal matters
- Conduct independent financial and tax advice where necessary
- Notify us of any changes that may affect the property search
We do not provide legal, financial, or taxation advice.
- Fees and Payment
Our fees will be clearly outlined in the Client Agreement and may include:
- Engagement fee
- Fixed service fee
- Success fee payable upon securing a property
Unless otherwise stated, the engagement fee is non-refundable once services commence.
Success fees are payable once a property has been successfully secured or exchanged.
All fees may be subject to GST where applicable.
- Independent Advice
Clients are strongly encouraged to obtain independent legal, financial, and tax advice before purchasing property.
While we provide research and guidance, all final purchase decisions remain the responsibility of the Client.
- No Guarantee of Performance
Property investment involves risk and market fluctuations.
We do not guarantee:
- Capital growth
- Rental yield or returns
- Future market performance
All property decisions are made at the Client’s discretion.
- Confidentiality
Both parties agree to keep confidential any personal, financial, or commercial information shared during the engagement.
Information will only be disclosed where required to deliver our services.
- Termination
Either party may terminate the agreement by providing written notice.
If termination occurs after work has commenced, the Client may still be responsible for:
- Engagement fees
- Work completed to date
- Any agreed costs incurred
- Limitation of Liability
To the maximum extent permitted by law, the Buyers Agency will not be liable for:
- Property investment losses
- Market changes
- Financial outcomes of property purchases
- Decisions made by the Client
Our liability is limited to the fees paid for our services.
- Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia.
